Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Equinoxx Fitness Studio, located at 12, 80 Feet Road, near RT Nagar Police Station, Bengaluru, Karnataka 560032 ("Studio", "we", "us"). By joining our studio, booking a class or using our website, you agree to these Terms. Please read them carefully.

1. Membership & Enrollment

Eligibility

Membership is open to individuals aged 16 and above. Members under 18 require written consent from a parent or guardian. All new members must complete a health declaration form before commencing training.

Membership Plans

We offer monthly, quarterly and half-yearly membership plans. Membership fees are non-transferable and non-refundable unless otherwise stated. Membership begins on the date of joining and expires on the agreed end date.

2. Health & Safety

Your Responsibility

You confirm that you are in good physical health and have no medical condition that would prevent safe participation in fitness activities. You agree to inform our trainers of any injuries, medical conditions or physical limitations before training.

Medical Clearance

If you have a pre-existing medical condition (heart disease, high blood pressure, diabetes, pregnancy, recent surgery), you must obtain written medical clearance from a doctor before joining. Equinoxx Fitness Studio reserves the right to decline membership on health grounds.

Risk Acknowledgment

Physical exercise carries inherent risks including injury. By participating in training at Equinoxx Fitness Studio, you acknowledge and accept these risks. Our trainers follow all safety protocols to minimize risk.

3. Code of Conduct

Expected Behaviour

All members are expected to behave respectfully toward staff, trainers and fellow members. Harassment, aggressive behaviour or use of abusive language will result in immediate termination of membership without refund.

Studio Rules

Members must wear appropriate workout attire and footwear at all times. Please wipe down equipment after use. Do not use equipment you have not been trained on. Mobile phones should be on silent during sessions. Personal training sessions must be booked in advance.

4. Payments & Refunds

Payment Terms

All membership fees are payable in advance. We accept cash payments at the studio, UPI, online bank transfer and card payments. A receipt will be provided for all payments.

Refund Policy

Membership fees are generally non-refundable. In exceptional circumstances (serious illness or injury with medical certificate), a pro-rated refund or membership freeze may be considered at the sole discretion of the management. Requests must be made within 7 days of the circumstance arising.

Membership Freeze

Members may request a membership freeze of up to 30 days per year due to travel or medical reasons. Freeze requests must be made in advance with at least 3 days notice.

5. Personal Training

Booking & Cancellation

Personal training sessions must be booked at least 24 hours in advance. Cancellations with less than 12 hours notice will forfeit the session. No-shows will be charged as a completed session.

Online Training

Mr. Gopal offers online personal training sessions for clients across India and internationally. Online sessions are subject to the same booking and cancellation policies.

6. Liability

Limitation of Liability

Equinoxx Fitness Studio, its trainers and staff are not liable for any injury, loss or damage sustained during training, except where caused by our gross negligence. We are not responsible for loss or theft of personal belongings on the premises.

Indemnity

You agree to indemnify and hold harmless Equinoxx Fitness Studio from any claims arising from your use of our services, your violation of these Terms or your violation of any rights of a third party.

7. Photography & Media

Consent

We may occasionally photograph or video training sessions for use on our website and social media. If you do not wish to be photographed, please inform us in writing. We will not publish images of members who have requested privacy.

8. Changes to Terms

Updates

We reserve the right to modify these Terms at any time. Changes will be communicated via our website or notice at the studio. Continued use of our services after changes constitutes acceptance of the updated Terms.

9. Governing Law

Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
